TERMS AND CONDITIONS |

All submitting individuals and firms (hereinafter referred to as “Entrants”) will submit and publish images and material on a public web site (hereinafter referred to as “Web Site”). By submitting these images and materials, the Entrants grant the Orange County Chapter of the American Institute of Architects and Webscape the right to publish, display, copy, and/or reproduce such copyrights owned, assigned, or licensed by the Entrants for purposes related to conducting the Orange County Chapter AIA Design Awards Competition. Entrants grant the Orange County Chapter AIA the right to retain Entrants’ submitted images for future publication, display, copying and reproduction related to the promotion, planning and conducting of future Orange County Chapter AIA Design Awards Competitions. Any and all present and future licensees or assigns to Entrants’ materials and images submitted for the 2007 Orange County Chapter AIA Design Awards Competition are also bound to the above terms.
By publishing material on the competition Web Site, the Entrants warrant that they are the rightful owners of the material or have secured the right to publish the material submitted for their Award Entry. In the event any claim of infringement, unfair competition, or any other claim for relief is made against the Orange County Chapter AIA, Webscape, and/or related entities regarding the ownership of the works displayed in an entry, the Entrant at issue shall indemnify and defend the above referenced parties against any claims of infringement or other claim for relief.
Prior to and during the judging, the authorship of all material will remain anonymous. No identifying marks or logos may be included in the submitted material. After judging, the link to the credits will be made available to the public.
Material from webscape.com or any Web Site owned, operated, licensed or controlled by Webscape and/or its affiliates is the intellectual property of Webscape and/or its affiliates and may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. Such intellectual property includes but is not limited to patents, copyrights, product names, logos, designs, titles, trade secrets, trademarks and service marks. Unauthorized use and/or modification of such materials will be considered a willful and direct infringement of Webscapes intellectual property and Webscape will seek all legal remedies available to enforce its rights.
Users of the Web Site may use the content only for noncommercial uses related to conducting the AIA Orange County Chapter AIA 2007 Design Awards. Users of the Web Service must obtain prior written permission from Webscape or its related entities for any use falling outside of this scope.

Webscape respects the privacy concerns of the visitors to its sites on the Internet. No personal information is automatically collected from visitors to its sites. However, certain non-personal information of visitors is recorded by the standard operation of Webscape's Internet servers. No cookies are used. E-mail addresses and other personally identifiable data about visitors to this site are known to Webscape and the Design Awards Committee only when voluntarily submitted. They are kept in strictest confidence and are not sold or otherwise transferred outside Webscape or beyond Orange County Chapter AIA Design Awards Competition use. |

Furthermore, neither the Orange County Chapter AIA, Onuma, Inc., nor its affiliated or related entities or its content providers are responsible or liable to any person or entity whatsoever (including, without limitation, persons who may use or rely on such data/materials or to whom such data/materials may be furnished) for any loss, damage (whether actual, consequential, punitive or otherwise), injury, claim, liability, or other cause of any kind or character whatsoever based upon or resulting from any use of the Web Site.
In the event any provision in this Disclaimer is found unenforceable, all remaining provisions shall have the full force and effect of the law.
